Summary
CoatingOS is CRM software for floor coating contractors. By using our service, you agree to use it lawfully, comply with messaging regulations, and understand that your data belongs to you.
1. Agreement to Terms
By accessing or using CoatingOS ("the Service") provided by Coating Cohort LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
CoatingOS is a customer relationship management (CRM) platform designed specifically for floor coating, epoxy, and polyaspartic contractors. The Service includes lead management, scheduling, estimates, invoicing, SMS/email messaging, payment processing, and marketing automation.
3. Account Registration
To use the Service, you must create an account with accurate information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Subscription & Payment
- ✓ 7-day free trial for new subscribers
- ✓ Cancel anytime, service continues through billing period
- ✓ Secure payment processing via Stripe
- Payments are billed monthly and are non-refundable except as required by law
- SMS/MMS credits are purchased separately and are non-refundable
- We reserve the right to change pricing with 30 days notice
5. Acceptable Use
You agree to use the Service responsibly. You must NOT:
- Use the Service for any unlawful purpose
- Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, TCPA)
- Harass, abuse, or harm others through the Service
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the Service infrastructure
⚠️ SMS/MMS Compliance: You are responsible for obtaining proper consent before sending marketing messages. Violations may result in account suspension.
6. Your Data & Ownership
🔐 Your Data Belongs to You
You retain all rights to your data. We do not claim ownership of any content you upload or create using the Service. You can export or delete your data at any time.
You grant us a limited, non-exclusive license to use your data solely to provide and improve the Service. We will never sell your data. See our Privacy Policy for complete details.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, the Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the past 12 months.
8. Termination
We may suspend or terminate your access for violations of these Terms, non-payment after reasonable notice, or for any reason with 30 days notice. Upon termination, you may request export of your data within 30 days.
9. Dispute Resolution
Any disputes will be resolved through informal resolution first, then mediation, and binding arbitration under AAA rules as a last resort. These Terms are governed by the laws of the State of Illinois, USA.
10. Changes to Terms
We may modify these Terms at any time with at least 14 days notice via email or in-app notification. Continued use after changes constitutes acceptance.
